Hyperplace LLC ("we," "us," "our") respects your privacy. This Policy explains how we collect, use, and protect personal information for our energy-optimization platform, smart-meter integrations, and related services.

2. Information We Collect

a) User-Provided Information: name, address, email, phone, property details, energy usage, communication preferences.

b) Automatically Collected: device info, IP address, cookies, analytics.

c) Third-Party Sources: energy data or tariffs from utilities or partners with your consent.

3. Purpose of Processing

Provide and improve services, analyze energy use, recommend tariffs, connect with partners, comply with law, prevent fraud, and maintain security.

We do not sell personal data.

Processing under Art. 6 GDPR:

5. Data Sharing and Partnerships

We work with certified partners, market participants, and subcontractors ("Partners") such as energy suppliers, installers, smart-meter providers, software vendors, and referral partners.

Partners may act as:

  • Processors (under our instructions)
  • Joint Controllers (shared purposes)
  • Independent Controllers (own contracts)

Hyperplace ensures that:

  • all Partners are bound by GDPR-compliant agreements (Art. 26 / 28);
  • they use data only to fulfill the service; and
  • no Partner may use data for unrelated marketing.

Data may be shared with local partners in EU countries (e.g., Germany or Austria) to fulfill customer requests. A list of partner categories is available on request via privacy@hyperplace.com.

6. International Transfers

Data may be processed in the USA. For EU users, transfers use Standard Contractual Clauses (SCCs) or the EU-US Data Privacy Framework, where applicable.

7. Retention

Data is kept only as long as necessary for service delivery or legal compliance (max. 5 years after last activity).

8. Your Rights (EU/EEA)

Access, rectification, erasure, restriction, objection, portability. You may also file a complaint with your local data-protection authority. Contact us at privacy@hyperplace.com.

9. Data Provision Notice

Certain data (such as contact and property information) is required to provide our Services. Without it, we may not be able to deliver requested functions.

10. Cookies and Tracking

Essential and analytics cookies only. EU users must consent to non-essential cookies via banner.

We use industry-standard encryption and access controls to protect data from unauthorized access or loss.

12. Children's Privacy

Not directed to children under 16. We do not knowingly collect their data.

13. California Residents (CCPA)

California users have access and deletion rights under CCPA. We do not sell personal information as defined therein.
